This Privacy Policy describes how shopMaricel.com (the “Site” or “we”) collects, uses, and discloses your Personal Information when you visit or make a purchase from shopMaricel.

Collecting Personal Information

When you visit shopMaricel, we collect certain information about your device, your interaction with shopMaricel, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information about an identifiable individual (including the information below) as “Personal Information”. See the list below for more information about what Personal Information we collect and why.

  • Device information
    • Purpose of collection: to load shopMaricel accurately for you, and to perform analytics on shopMaricel usage to optimize shopMaricel.
    • Source of collection: Collected automatically when you access shopMaricel using cookies, log files, web beacons, tags, or pixels. 
    • Disclosure for a business purpose: shared with our processor Shopify.  
    • Personal Information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with shopMaricel
  • Order information
    • Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
    • Source of collection: collected from you.
    • Disclosure for a business purpose: shared with our processor Shopify, USPS, or UPS.   
    • Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers or debit card numbers), email address, and phone number.
  • Customer support information
    • Purpose of collection: to provide you information, services, and to communicate with you.  
    • Source of collection: collected from you. 
    • Purpose of collection: to provide customer support.
    • Source of collection: collected from you.  

Mobile Terms of Service

The shopMaricel mobile message service (the "Service") is operated by shopMaricel (“Maricel”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to shopMaricel’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of shopMaricel through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with shopMaricel. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18333828104 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Maricel mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

We respect your right to privacy. 

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

  • We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Behavioral Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

  • We use Shopify Audiences to help us show ads on other websites with our advertising partners to buyers who made purchases with other Shopify merchants and who may also be interested in what we have to offer. We also share information about your use of shopMaricel, your purchases, and the email address associated with your purchases with Shopify Audiences, through which other Shopify merchants may make offers you may be interested in.

Using Personal Information

shopMaricel may collect and use information to improve customer service and relationship, to enhance user experience, to send periodic notifications and promotions to valued clients, for custom orders and for payment transactions.

  • Improving Customer Relationship: Information collected from you allows us to respond to customer service inquiries, support needs and requests more efficiently.
  • Enhancing User Experience: We value client and user feedback. We may use client and user feedback to improve our products, services and to make the shopMaricel website browsing experience friendly for you.
  • Periodic Email Notifications: Information you provide, such as your email will be used to send periodic emails to our clients and users who opt in to our mailing list. You may receive newsletters that may include promotional updates and informative articles about shopMaricel products, services and our brand. If you choose not to receive any of these, we provide an option to unsubscribe at the very bottom of each email.
  • Custom Orders: Our service includes creating custom pieces with specified details from our clients. Your email address is as necessary as your phone number to communicate specific details with you. This helps us deliver the jewelry you want for you perfectly.
  • Payment Method: Your name, credit card or debit card information, correct billing and shipping address will be collected to complete a payment transaction.

Selling Personal Information

shopMaricel does not sell your Personal Information, as defined by the California Consumer Privacy Act of 2018 (“CCPA”).

If you are a resident of California, you have the right to access the Personal Information shopMaricel holds about you (also known as the ‘Right to Know’), to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Cookies

A cookie is a small amount of information that’s downloaded to your computer or device when you visit shopMaricel. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing shopMaricel to remember your actions and preferences (such as login and region selection). This means you don’t have to re-enter this information each time you return to shopMaricel or browse from one page to another. Cookies also provide information on how people use shopMaricel, for instance whether it’s their first time visiting or if they are a frequent visitor.

Do Not Track

Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, shopMaricel does not alter its data collection and usage practices when we detect such a signal from your browser.

shopMaricel may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
